Minutes 20th April 2017

Parish Council meeting on Thursday 20th April 2017 at 7.30pm at
Bromyard and Winslow Town Council Offices


Present: Paul Friend (Chairman), David Boddington, Helen Allan, Roger Steeds, Peter Stoddart
In attendance: David Hunter-Miller (Clerk), Councillor Nigel Shaw, Janet Green and Chris Green (Footpaths Officers)

1. To accept apologies for absence
Apologies received from Dave Cave, Shaun Simpson, Clive Brazier, Karen Rock.

2. To receive declarations of interest and written requests for dispensation
Nil received.

3. Open Session:

1. Report from the Ward Councillor, Nigel Shaw
An update was given on the Velo Birmingham cycling event that would pass through the Parish. Herefordshire Council contacted the Velo organisers regarding consultation, road closures and access and are awaiting a response.
It was confirmed that the court date for the Saltmarshe had been postponed until 4th May 2017.
There would be a consultation event for the Rural Areas Development Plan on the 22nd May at 10AM. This plan deals with areas not covered by a separate Neighbourhood Development Plan, it was confirmed that Linton may potentially be affected.
Ward Cllr Shaw had received an interim response from the Director of Public Health regarding Cllr Boddington’s report on health concerns at Clater Park. The matter is being investigated with Herefordshire Council’s Environmental Health officers.
2. Update from Bromyard Downs Common Association (BDCA)
Cllr Rock was unable to attend the meeting and give a report. It was confirmed that the BDCA’s AGM was scheduled for the 10th May 2017.
3. Update from Bringsty Common Manorial Court (BCMC)
Cllr Friend provided an update on the BCMC, concerns were raised regarding the likelihood of future funding from Natural England.
Noise complaints had been received following the Bromyard Speed Festival.
Cllr Williams joined the meeting.
A query was raised on why some tracks across the common land had seen resurfacing but other tracks had not, it was confirmed that this was because Herefordshire Council is responsible for any Byways Open to All Traffic.

4. Report from the Footpaths Officer, Janet Green
The Footpaths Officer has been in discussions with Herefordshire Council and Bromyard Motocross Track regarding an obstructed footpath. Herefordshire Council have confirmed that adequate notice should be given before closing a footway. Cllr Steeds suggested that a permanent diversion should be sought as this would be an ongoing issue.

5. Public Participation (10 minutes)

4. To consider and adopt the minutes from the Parish Council meeting on 16th March 2017
The minutes of the Parish Council meeting were approved and signed as a true record by the Chairman.

5. Finance:

1. Clerks salary and administration expenses: £207.20
2. HMRC PAYE: £45.20
3. Balfour Beatty Living Places: £170.00
The Council agreed the payments as listed
4. Update on bank account issues and mandate change
The Clerk provided the necessary paperwork to add Cllr Cave, Cllr Rock and Cllr Allen as signatories.

6. Planning:

1. P170759/F – Planning Permission. New Barns, Norton, Bromyard, Herefordshire, HR7 4PA. Application for variation of condition 4 of planning permission P152248/F. To allow boarding of 80 dogs.
No objections were raised by the Council.

7. Consideration of draft letters circulated by Cllr Steeds
Permanent fencing of Bromyard Downs – Cllr Steeds outlined concerns regarding the proposals to erect fencing. The Council agreed to request a copy of the BDCA’s minutes so that the matter could be debated further at a future meeting.
Bylaws – Cllr Steeds raised concern at the legitimacy of statements made by the BDCA concerning bylaws and asked that the bylaws be posted visibly on site. Ward Cllr Shaw confirmed that a blanket ban on dog fouling applies to all Herefordshire Council land and will circulate a briefing note. The Council agreed to request copy of 1994 bylaws and BDCA’s minutes so the matter could be debated at the next meeting.
Clater Park – The Clerk provided an update on correspondence received from the Environment Agency, who were investigating some of the issues but considered that the land drainage matters would be the responsibility of the Herefordshire Council. The Parish Council agreed that the Clerk would continue to liaise with the Environment Agency and would make sure that the land drainage issues were picked up by the relevant authority. Cllr Boddington extends the thanks of the Parish Council to Cllr Steeds for his work on this issue.

8. Further consideration of health concerns at Clater Park
Matter raised by Cllr Shaw in item 3.1: Open Session.

9. Replacement notice boards
Cllr Friend proposed the purchase of a further replacement notice board, suggesting that a larger size would be better so as to accommodate both Parish Council and public notices. It was agreed that the Clerk would identify the costs for the next meeting.

10. Parish Council website update
An update on the Transparency Funding was given by the Clerk. It was agreed that the Council would move forward with the construction of the new website, with a “.gov” website domain being preferred. The Clerk would work with the Herefordshire Association of Local Councils and Eyelid Productions to progress.

11. To consider the date and format of the Annual Parish Meeting
It was agreed that both the Annual Council Meeting and Annual Parish Meeting would be held on Thursday 18th May, to start at the earlier time of 7:00PM, to be held at the Bromyard and Winslow Town Council Offices.
